Several federal statutes play a role in the regulation of railways in Canada, particularly the Railway Safety Act and the regulations and rules made pursuant to it, such as the Grade Crossings Regulations and the Railway Safety Administrative Monetary Penalties Regulations.
The Tribunal hears reviews and appeals of Federal administrative and enforcement actions taken under the Act. Regulatory amendments, including the creation of administrative monetary penalties, have led to enforcement actions in the rail sector.

If a party is unable to attend a scheduled Transportation Appeal Tribunal of Canada (Tribunal) hearing, they should contact the Tribunal immediately. If a party (or a party's representative) fails to appear at a scheduled Tribunal hearing, the Tribunal may choose to allow the hearing to proceed in the party's absence.
A party's failure to appear at a review hearing without sufficient reason to justify their absence may also result in the loss of their right to appeal the review determination.
