The primary legislation governing civil aviation in Canada is the Aeronautics Act. The Tribunal hears reviews and appeals relating to a number of regulations made pursuant to the Act, including the Canadian Aviation Regulations.

If a party is unable to attend a scheduled Transportation Appeal Tribunal of Canada (Tribunal) hearing, they should contact the Tribunal immediately. If a party (or a party's representative) fails to appear at a scheduled Tribunal hearing, the Tribunal may choose to allow the hearing to proceed in the party's absence.

A party's failure to appear at a review hearing without sufficient reason to justify their absence may also result in the loss of their right to appeal the review determination.

Some statutes provide the Transportation Appeal Tribunal of Canada (Tribunal) jurisdiction to accept applications for review after the 30‑day deadline provided by statute has passed.

Where this discretion is provided by statute, the Tribunal will apply the following policy to review requests that are received by the Tribunal five or more business days after the 30-day deadline (late request):
