The primary legislation governing civil aviation in Canada is the Aeronautics Act. The Tribunal hears reviews and appeals relating to a number of regulations made pursuant to the Act, including the Canadian Aviation Regulations.

Policy in regard to Failure to Appear

If a party is unable to attend a scheduled Transportation Appeal Tribunal of Canada (Tribunal) hearing, they should contact the Tribunal immediately. If a party (or a party's representative) fails to appear at a scheduled Tribunal hearing, the Tribunal may choose to allow the hearing to proceed in the party's absence.

A party's failure to appear at a review hearing without sufficient reason to justify their absence may also result in the loss of their right to appeal the review determination.

Policy on Late Applications

Some statutes provide the Transportation Appeal Tribunal of Canada (Tribunal) jurisdiction to accept applications for review after the 30‑day deadline provided by statute has passed.

Where this discretion is provided by statute, the Tribunal will apply the following policy to review requests that are received by the Tribunal five or more business days after the 30-day deadline (late request):

With law degrees from the Université de Montréal and the École du Barreau du Québec, Martine Guay had a long career in the federal public service, first as a legal translator-reviser and then as a manager. She later went back to school to become a nurse and has since worked in the fields of women’s health and research. Ms. Guay holds a master’s degree in nursing from the Université de Montréal. In addition to her thesis, she has several publications to her credit and has contributed to numerous academic texts.

Dr. Antoine Gagnon is a bilingual family physician practicing in Osgoode, Ontario. He earned his Doctor of Medicine degree from the University of Ottawa in 2004 and completed his family medicine residency in 2006. Dr. Gagnon has been certified by the College of Family Physicians of Canada since June 15, 2006.

Throughout his career as an airline pilot, Mr. Wilson has flown domestic, transatlantic, trans-Pacific, transpolar, and South America routes.
